Terms of Service

1. Acceptance of Terms

By accessing or using The Medical City Endocrine Diseases Registry (“the Registry”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any applicable guidelines or policies referenced herein. The Registry is operated under the laws of the Republic of the Philippines. If you do not agree with any part of these Terms, you must not use the platform.

Your acceptance of these Terms forms a legally binding agreement between you and The Medical City, the operator of the Registry. If you are using the Registry on behalf of a hospital, medical department, or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

The Registry is a clinical disease registry for endocrine diseases, including diabetes and thyroid disorders, operated by The Medical City, Philippines. It provides two categories of access:

  • Authenticated access (Doctor Portal): Licensed physicians may register patients, enter clinical data, and manage records related to their patients.
  • Administrative access (Dashboard): Authorized personnel may view aggregated, de-identified statistics derived from registry data for clinical oversight and research.

The Registry is provided free of charge to authorized physicians as a research and clinical quality improvement tool. No fees are charged for registration or use.

3. Eligibility and Account Registration

3.1 Eligibility

Only licensed physicians with a valid PRC (Professional Regulation Commission) license number and affiliation with a participating hospital may register for an account. Accounts are subject to verification and administrative approval.

3.2 Account Registration

You must provide true, accurate, current, and complete information during the registration process. You are responsible for maintaining the accuracy of your account information. Each physician may maintain only one account. You must not share your login credentials with any other person.

3.3 Account Security

You are responsible for all activity conducted under your account. If you suspect unauthorized access, notify the Registry administrator immediately. You must not use another physician’s account or allow others to use yours. The Registry reserves the right to suspend or terminate accounts that violate these Terms.

4. Data Entry Responsibilities

4.1 Physician Obligations

Authenticated users are responsible for:

  • Entering accurate, complete, and truthful clinical data
  • Obtaining and documenting informed consent from each patient prior to enrollment, in accordance with RA 10173
  • Updating patient records in a timely manner following clinical encounters
  • Maintaining the confidentiality of their account credentials
  • Ensuring they have the necessary consent and legal authority to upload patient data to the Registry

4.2 Accuracy Requirements

Clinical data must be entered using the standardized coding systems provided by the platform (ICD-10, WHO 2022 PitNET Classification, LOINC, Knosp grading). Users must not fabricate, falsify, or deliberately misrepresent clinical data. Inaccurate data compromises research integrity and may result in account suspension.

4.3 Patient Consent

The enrolling physician is the Personal Information Controller with respect to the patient data they submit. The physician bears full responsibility for securing informed consent from each patient before entering data into the Registry. The consent must cover the purpose of the Registry, the types of data collected, how the data will be used, and the patient’s right to withdraw consent at any time.

5. Terms for Administrative Users (Statistics)

5.1 Permitted Use

Statistics are provided for clinical oversight, quality improvement, and internal research purposes at The Medical City. Authorized personnel may cite Registry statistics in internal reports and approved academic publications with appropriate attribution.

5.2 Prohibited Use

You must not:

  • Attempt to re-identify any individual patient from aggregated statistics
  • Link Registry statistics with external datasets for the purpose of identifying individuals
  • Misrepresent Registry data or present aggregated statistics as individual-level data
  • Use automated scraping tools to extract data from the statistics dashboard without written permission

5.3 Attribution

When citing Registry statistics, please use the following format:

6. Intellectual Property

6.1 Registry Ownership

The Registry platform, including its design, software, interface, graphics, trademarks, and all other content and materials (“Registry Materials”), is owned by The Medical City and/or its licensors. All rights, title, and interest in the Registry Materials are reserved. Your use of the Registry does not grant you any ownership or intellectual property rights in the Registry Materials.

6.2 User Data Ownership

Clinical data entered by physicians remains under the control of the enrolling physician and The Medical City. By submitting data to the Registry, you grant The Medical City a non-exclusive, royalty-free license to use such data in aggregate, de-identified form for research, education, quality improvement, and public health purposes.

6.3 Restrictions

You must not copy, modify, distribute, reverse engineer, decompile, or create derivative works from the Registry Materials without prior written consent from The Medical City.

7. Prohibited Activities

In addition to the restrictions set forth elsewhere in these Terms, you must not:

  • Use the Registry for any unlawful purpose or in violation of any applicable law or regulation
  • Upload malicious code, viruses, or any harmful material to the platform
  • Interfere with or disrupt the integrity or performance of the Registry
  • Access or attempt to access data belonging to other physicians or their patients
  • Sell, resell, sublicense, or commercially exploit any part of the Registry or Registry Materials
  • Impersonate another physician or misrepresent your professional credentials

8. Disclaimers

The Registry is provided “as is” and “as available” without warranty of any kind, either express or implied. Registry statistics are derived from voluntarily submitted clinical data and represent the clinical experience of patients at The Medical City.

The Registry does not provide medical advice and should not be used as a substitute for professional medical judgment. The Medical City does not guarantee the accuracy, completeness, or reliability of any data entered by users, nor does it warrant uninterrupted or error-free operation of the platform. Registry statistics reflect data specifically from our facility and may not represent the broader population outside of The Medical City.

9. Limitation of Liability

To the maximum extent permitted by Philippine law, The Medical City, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the Registry
  • Any errors, inaccuracies, or omissions in the data
  • Unauthorized access to or alteration of your data
  • Any reliance on Registry statistics for clinical decision-making
  • Service interruptions, downtime, or data loss

10. Indemnification

You agree to defend, indemnify, and hold harmless The Medical City, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or relating to:

  • Your use or misuse of the Registry
  • Your breach of these Terms or applicable law
  • Your failure to obtain proper patient consent
  • The inaccuracy or falsification of data you submit

11. Account Termination

11.1 By the User

You may request account deactivation at any time by contacting the Registry administrator. Upon deactivation, your access to the Doctor Portal will be revoked. Clinical data you have entered will be retained in the Registry in accordance with the data retention policy described in our Privacy Policy.

11.2 By the Registry

The Registry may suspend or terminate your account immediately if:

  • You breach any provision of these Terms
  • Your PRC license is suspended, revoked, or expired
  • You are found to have fabricated or falsified clinical data
  • Continued use of your account poses a risk to data integrity, patient privacy, or Registry security

11.3 Effect of Termination

Upon termination, your right to access the Registry ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) will continue in effect.

12. Force Majeure

The Registry shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, power failures, internet outages, epidemics, civil unrest, or cyberattacks.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts of Pasig City, Metro Manila, Philippines.

14. Modifications

The Registry reserves the right to modify these Terms at any time. Material changes will be communicated to authenticated users via email at least thirty (30) days before the effective date, and posted on this page with an updated revision date. Your continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be interpreted to fulfill its intended purpose to the greatest extent permitted by applicable law.
